1. PURPOSE

The present terms and conditions of sale regulate the agreement between the company BORDAL – Bordados da Madeira, Lda. Headquartered in Rua Dr. Fernão Ornelas, 77, Funchal, Madeira, Portugal duly registered at the Commercial Register of Funchal (“Bordal – Bordados da Madeira”) and the costumer, formalized through the website www.bordal.pt for the purchase of Bordal products through the online store.

2. CONTRACTUAL PROCEDURES

2.1. Eligibility to purchase
To make an order through the website , the Customer must be 18 years or more and has to be the final consumer. Under age are expressly excluded.
If the Customer is not registered on the site and place an order , will be automatically registered such as in the Bordal system.

2.2. How to place an order
To place an order through the website of Bordal , you must follow the following steps:

1º You may register on Bordal website in the beginning or in the end of choosing your products. The login link, present in the top bar gives you the access to registration form or login as a registered user.

2º Select the product you want, enter the amount and add them to your "shopping car".

3º The customer can continue shopping by selecting other items, following the same steps. When finish choosing the items, customer can click ' Checkout Now '.  

4º At this stage , you may proceed to authenticate your account or create one if you
haven’t done already by registering on the website.

5º Insert information about the delivery and billing.

6º Selection of payment method and click " Send order " . By activating the " Send Order " button on the order form , you accept fully and without reservation all the Terms and Conditions of Sale as indicated on the site at the time of your purchase.

7º Make payment.

8º As the confirmed / authorized payment, the Customer will receive an order confirmation. Except for the circumstances described in sections 2.3 and 2.4 below, this confirmation constitutes acceptance by the Bordal Customer Order and creates a binding agreement between the Customer and Bordal.

9º It is recommended that the client print and / or save a copy of the Terms and Conditions of Sale when making the order. It will be sent a copy of the confirmation to the costumer’s email address. We recommended to print your copy of transfer as well for possible future reference.

10º Bordal may change the Terms and Conditions at any time without noticing you. However, Bordal announce these changes on the website. Also, once the Customer has received the order of receipt of confirmation from Bordal, the Sale Terms and Conditions applicable to that order will not be changed.

2.3. Product Availability
The deadline of an order placed through the website is subject to the availability of selected items. Bordal will contact the customer to inform him of the deadline. This will differ according to the time that is required for the production of articles if they do not exist in stock.


2.4. Bordal has the right to cancel or not to accept an order
Bordal reserves the right to reject orders, as well as cancel or not accept a confirmed order for the following reasons, among others:
•    Occurrence of a technical error or errors on prices on the website at the time the order was made.
•    The product is not available in stock or production.
•    The billing information provided are incorrect or not checked.
•    Security systems indicate that the order is abnormal or may be fraudulent.
•    To have reason to believe that the Customer is under 18 years.
•    After 2 attempts, the Bordal can not deliver your order at the address indicated.
If an order is canceled for any of the reasons above, Bordal refund (if applicable) the order value. Except in certain circumstances, the delivery costs are never reimbursed.

2.5. Data verification
Before processing an order placed by Customer, Bordal can check the customer data. This may mean checking the address and the client 's solvency, and if it is involved in any kind of fraud. For possible fraud, Bordal can use a partially automatic verification of all purchases to filter those considered abnormal or suspicious and those suspected of fraud. Suspected fraud orders will be investigated and the Customer may be reported to the appropriate authorities and may be prosecuted.

3. RESPONSIBILITY

3.1. These Terms and Conditions of Sale define the full extent of the obligations and responsibilities of Bordal for the supply of products. There are no warranties, conditions or other terms that are binding on Bordal except as expressly stated in the Terms and Conditions of Sale gifts.

3.2. Subject to clause 3.4 , the maximum aggregate liability of one part against another on any claim or related to these Terms and Conditions of Sale , in terms of contract, warranty , condition , tort , strict liability , statute or otherwise , SHALL BE LIMITED TO THE AMOUNT PAID TO Bordal THE PRODUCT IN QUESTION.

3.3. Subject to clause 3.4, WHETHER DUE TO BREACH OF CONTRACT, WARRANTY, CONDITION, TORT , STRICT LIABILITY LAW OR OTHERWISE , NO BE PART , IN NO EVENT LIABLE TO THE OTHER FOR ANY SPECIAL , CONSEQUENTIAL , INCIDENTAL OR INDIRECT.

3.4. Nothing in these Terms and Conditions of Sale shall limit or exclude the liability of Bordal for (i) death or injury caused by the negligence of Bordal , ( ii ) fraud, ( iii ) any breach of the obligations implied by mandatory applicable national legislation or ( iv ) any liability which can not be excluded by law.

4.APPLICABLE LAW

Purchases made through the website of Bordal and under these Terms and Conditions of Sale are subject to Portuguese law.

5. JURISDICTION

Any dispute or discrepancy arising from the application or interpretation of the Terms and Conditions of Sale present, as well as contracts that are part of the same shall be settled in the courts of the city of Funchal, Madeira, Portugal, which will have exclusive jurisdiction over any other jurisdiction. However, if the customer have the consumer status under the Portuguese Law for the Consumers Defence and Users, the competent courts will be the consumer 's place of residence in Portuguese territory.
